General Terms

These Terms and Conditions of Use apply to all portions of the Site www.massagechoices.com and its subdomains, and includes all pages and materials contained in, or used by, any portion of the site. The Site is the property of Massage Choices Inc. BY USING THE SITE, YOU ARE AGREEING FULLY TO THESE TERMS OF USE. As long as you comply with these terms, Massage Choices Inc grants you permission to enter and use the Site. For this document and all other terms of use agreements, Massage Choices Inc, we, us, or our, refers to any and all officers, employees and any parent or holding company and its officers, of Massage Choices Inc, which operates out of Miami-Dade Florida.

Additional terms

The Site is continuously growing. We invision this growth extending well into the future. Our origional design described three main parts to the site. As each part, and any other areas are added, we may modify these terms and add additional terms, on separate pages from the those contained here. By using any new services we introduce, you fully accept the terms relevant to those services and they become part of your agreement with us.

Content

Content collectively refers to all text, graphics, sounds, music, photographs, artwork, trademarks, logos, user interfaces, visual designs, and computer code, which composes, or is contained in the Site, including but not limited to the design, selection, and arrangement of such. Content contained on the Site is owned, or licensed by or to Massage Choices Inc, and is protected by copyright laws, and various other intellectual property rights and laws.

No part of the Site or its content may be copied, reproduced, translated, uploaded, republished, displayed publicly, transmitted or distributed in any way to another Web site or other medium of publication or distribution or for any commercial purpose, without Massage Choices' express prior written consent.

We cannot be held accountable for content that has become outdated or obsolete. Conversely we may make any changes to the Site at any time and without notice. Changes that we make may affect the products, services or promotions, as well as the applicable prices for any products or services.

This Site may contain links to other independent third-party web sites. Links to these sites are provided as a convenience to our visitors, and the sites themselves are not under our control. Massage Choices is not responsible for and does not endorse the content of these sites. In addition, Massage Choices is not responsible for the availability of any such external sites or resources. Your use of these sites is solely your responsibility. You agree that you may not hold Massage Choices responsible for any damages that may occur as a result of visiting these external sites.

Use of the Site

Non-member Use.

Visitors to the Site which are not members or listing owners agree to use the Site strictly for informational purposes specifically provided by the Site.

Use by Member/Listing Owner

As a Listing owner or member of the Site you agree to use the Site in accordance to all terms of use for both informational purposes and for promoting your business or services through its business listing services and ad placement. In order to list your business or place an ad you are required to open an account. Although the act of opening an account does not incur any financial obligation, you are entirely responsible keeping your account password information confidential. You are also fully responsible for any loss resulting from your failure to maintain this information secure. In the event that your information is stolen or you notice any unauthorized access of your account, you must notify us immediately so that we may take the proper actions to secure your account. We will not be liable for any loss or damages which may occur due to your failure to comply with these terms.

All Users

You may not circumvent the navigational structure or presentation of the Site for any reason. You may not attempt to obtain any materials, documents or information from the Site through any means not purposely made available through the Site's navigation structure. You may not attempt to gain unauthorized access to any restricted portion or feature of the Site, or any other networks connected to the Site by any illegitimate means. You may not test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site. You may not use any illegitimate means through the Site to seek information on any user of the Site whether that user is a visitor or listing owner, unless the Site already provides such information through its public navigation structure, and that information was publicly provided on the Site by its user.

You agree not to perform any malicious action which interferes with the proper workings of the Site or its processes, transactions, traffic, or with any other person's use of the Site.

Although a high level of security is implemented throughout the Site, internet communication cannot be made completely secure. You are aware that this is the inherent nature of the internet, and therefore, any communications that you conduct with the Site may possibly be intercepted.

Uploads and Contributions

You agree that you will not upload any content, whether it be for informational or advertisement purposes, that may be offensive in nature, or attempt to slander the Site or any of the users of the Site. You agree not to upload any media in the form of images, video, flash media, graphics, audio, or text which may contain or attempt to represent any form of pornographic imagery. Any comments which you submit, be it as part of a review or as some type of information you are providing must not contain any foul or discriminatory language. You will not attempt to upload any content that may contain any form of virus, trojan, worm of spyware. By uploading content to the Site you attest that you have taken reasonable measures to ensure that such content is free of any such malware. We reserve the right to bar or edit any content that you submit onto the Site which we believe violates any of these guidelines.

Listing Submittals

Any content uploaded as media or entered as text for submittal purposes must be of relevant nature to the Site, free of discriminatory or offensive language or imagery, and conform to the terms for Uploads and Contributions. You are fully responsible for any information you submit to the Site. All general listings, with the exception of upgraded listings, appearing in the search results are randomized during page loads. Upgraded listings are sorted on a first come basis. All other rules which govern inclusion of genral listigs in search results that apply to non-upgraded listings also apply to upgraded listings.

All ad materials will be reviewed before placement on the Site and must conform to the terms for Uploads and Contributions. Any ad material which does not meet these guidelines will be rejected.

In accordance with search engine and ethical internet use guidelines we take certain measures when placing a paid advertisement link on our site. Please read the guidelines for paid ads before purchasing an ad.

Reviews Policy

We reserve the right to edit or remove any review that does not meet the following guidelines:

You will not submit a review that is offensive or contains inappropriate language. You agree that your review is a fair representation of the experience you had upon visiting the establishment for which you are reviewing. You agree not to submit multiple reviews for an establishment unless the later review is a correction to a prior submittal which contradicts something in the previous instance, or you have revisited the establishment and have a new and varying opinion from your previous review. In either case, you agree not to submit more than three reviews for any one establishment regardless of the reason. You agree not to slander an establishment with false or dishonest information. You will not submit a review for self promotion or personal gain of any kind. You will not use the review form for any of the following: advertising, spamming, sending messages of any kind or attempting to mislead for any reason. Also you will not attempt to send non text entries as reviews.

Failure to follow the Review Policy will cause your review to be deleted. Reviews are also deleted in the event that the account for which the review is made is purged. If an account has been purged and said account re-submits a listing, the new listing will not retain any prior reviews. Accounts are purged after being inactive for ninety days following their expiration or creation date, whichever occurs last.

Disclaimers

Massage Choices does not guarantee that the Site will be free of any errors nor that any information entered into the Site will remain intact and available at all times. We are not responsible for any loss of information or damages incurred from your use of the Site or its services due to any of the following: user error, server or connection problems, faulty coding, software bugs, viruses, security breaches, outdated or incompatible software, or natural disasters, as well as any of these causes arising from the use of outside sites reached through links from the Site. The Site and its services are provided as is and no promises are made that any errors will be corrected, browser compatibility issues will be addressed or updates will be performed during any given time period. We do however, reserve the right to make any changes, updates, or perform maintenance which might at times disrupt the availability or performance of the Site. We also reserve the right to add or remove content as we deem necessary.

Limitation of Liability

Except where prohibited by law, we cannot be held liable for any damages or loss incurred by your use of the Site for business, advertising, informational, or personal reasons. This applies to any damages, liability or injuries caused by any performance failure, omission, error or defect, deletion, interruption or delay in operation or transmission as well as any communication line failure, computer virus, trojan, worm, or spyware, theft, unauthorized access, destruction or alteration of, or use, whether because of negligence or any other cause or action.

We disclaim any and all liability for the actions of any third parties related to your use of the Site. This includes any and all conduct or omissions or as well as any services that are provided. You assume total responsibility for your use of the Site and any linked sites. The sole remedy for any dissatisfaction you may have with the Site or its content is to terminate your use of the Site.

Privacy Policy

Massage Choices does not share, distribute or sell any private information you provide as part of your use of this Site. We will never give your personal or account information to anyone unless required by law as in the case of an investigation. You should however be aware that from time to time we make use of Google's ad server to bring you relevant third party ads. Third party vendors, including Google, use cookies to serve ads based on a user's prior visits to the Site. Google's use of the DART cookie enables it and its partners to serve ads to users based on their visit to sites on the Internet. Visit Google.com for more information on their advertising policies. Refunds

Our goal is to provide our users with more value than what they've ever had before, or will ever be able to find anywhere else. We offer every new member a 30 day trial period free of charge, so they may ascertain the value that the site brings to them. However, for members that sign up for any plan, we offer a money back guarantee for any time not used on their plan period, prorated on the lowest plan in which the time used falls under, minus a 5% service fee. For example: if a user signs up for a year and decides to terminate the plan three months after signing up, the user will receive the amount they sign up for - (1/2 the price of the 6 month membership + 5% of the amount they initially paid). In this example, if the year membership is $100 and the 6 month membership is 60.00, the user would get a refund for $65.00 (100 - (30 + 5)). A lifetime member who wishes to terminate a listing after two years is not entitled to a refund.

Massage Choices Inc reserves the right to bar any activity which attempts to circumvent or disregard any of the terms of use as well as all malicious or inappropriate actions on the part of any user or visitor of the Site. Massage Choices Inc also reserves the right to change, modify, add or remove portions of these Terms of Use, at any time and without notice. It is your responsibility to check these Terms of Use periodically for any changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to these changes.
